Terms & Conditions

Effective Date: October 22, 2026

This Visitor Agreement applies to each person entering HofVeld Farm, operated by HofVeld Farm LLC, in Finksburg, Maryland. By entering the property or participating in an experience, the visitor acknowledges the nature of the property and agrees to the terms below.

1. Nature of the Property and Activities

HofVeld Farm is an outdoor farm property. Experiences may include seasonal picture settings, walking through designated outdoor areas, fireside experiences, food or beverage add ons, special animal visits, and other seasonal activities. Conditions may change because of weather, terrain, animals, maintenance, and normal farm operations.

2. Acknowledgment and Assumption of Risk

Visitors understand that a farm and outdoor environment involves inherent and other risks. These may include uneven or changing ground, grass, mud, wet or slippery areas, rocks, roots, holes, slopes, insects, plants, weather, falling branches, low visibility, parking areas, vehicles, farm equipment, smoke, sparks, fire, hot surfaces, food, allergens, and contact with or proximity to animals. Visitors voluntarily choose to enter and participate with knowledge of these risks and accept responsibility for risks that are inherent in or reasonably associated with the visit, to the fullest extent permitted by applicable law.

3. Fireside Experiences

Open flames, embers, smoke, hot fire pits, hot tools, and heated surfaces can cause burns, fire, smoke exposure, or other injury. Guests must remain within designated areas, follow all posted and staff instructions, and keep children under direct adult supervision. Guests may not move a fire pit, add unauthorized materials to a fire, engage in horseplay near a fire, or interfere with fire safety equipment. HofVeld Farm may suspend or end a fireside experience when conditions are unsafe.

4. Children and Supervision

Children must remain under the direct supervision of a responsible adult at all times. Parents and legal guardians are responsible for determining whether an activity is appropriate for a child and for enforcing farm and safety rules. A person completing a reservation should not represent that they have authority to sign legal rights away for another adult or for a minor unless that authority exists under applicable law.

5. Animals

Animals can behave unpredictably. Guests must follow handler and staff instructions and may touch, feed, approach, or photograph animals only when permitted. Running, chasing, startling, climbing on, or entering an animal area without permission is prohibited. Visiting animals may be present only on selected dates and may not be permanently housed at HofVeld Farm.

6. Personal Property

Visitors are responsible for their own phones, cameras, bags, clothing, vehicles, and other personal property. HofVeld Farm is not responsible for ordinary loss, theft, or damage to personal property except to the extent responsibility cannot lawfully be excluded.

7. Health and Personal Readiness

Visitors are responsible for considering their own mobility, allergies, sensitivities, and ability to safely participate in an outdoor farm experience. Guests who require an accommodation are encouraged to contact HofVeld Farm before the visit so available options can be discussed.

8. Farm Rules and Restricted Areas

Visitors must remain in designated guest areas, obey signs and staff instructions, supervise children, respect barriers, and avoid equipment, buildings, fields, wooded areas, animals, or other locations that are not open to guests. Smoking, vaping, weapons, unlawful substances, unsafe conduct, and conduct that threatens people, animals, property, or operations are prohibited. HofVeld Farm may require a guest to leave for unsafe, disruptive, unlawful, or noncompliant conduct.

9. Photography and Recording

Personal photography is permitted in designated areas during the visitor's reserved time. Professional or commercial photography, paid mini sessions, or photography involving multiple client groups may require advance permission and a separate arrangement. Visitors should respect the privacy of other guests and may not interfere with another party's reserved area or experience.

10. Emergency and Medical Assistance

In an emergency, HofVeld Farm may contact emergency services and provide reasonable assistance. Visitors remain responsible for their own medical expenses and for providing accurate emergency information when requested.

11. Release and Limitation of Claims

To the fullest extent permitted by applicable law, the visitor releases and agrees not to hold HofVeld Farm LLC, its members, managers, employees, contractors, volunteers, agents, property owners, and event partners responsible for claims arising from risks the visitor knowingly and voluntarily assumes under this Agreement. Nothing in this Agreement is intended to waive rights or liabilities that cannot legally be waived, including any liability that applicable law does not permit a business to disclaim.

12. Indemnity for Visitor Conduct

To the fullest extent permitted by law, a visitor agrees to be responsible for loss, damage, or claims caused by that visitor's unlawful, reckless, intentionally harmful, or materially rule violating conduct, including conduct by a minor or guest for whom the visitor is legally responsible.

13. Electronic Acceptance

Where this Agreement is presented electronically, checking the acceptance box and completing the reservation is intended to serve as the visitor's electronic acknowledgment and acceptance of these terms. The reservation record may be retained as evidence of acceptance.

14. Governing Law and Severability

This Agreement is governed by applicable Maryland law. If a provision is found unenforceable, the remaining provisions should continue to the fullest extent permitted by law.
